Terms of Service

Agreement to Terms

By accessing or using Snowy Studio at studio.snowy.work ("the Service"), you agree to be bound by these Terms of Service ("Terms"). The Service is operated by ZYEYZ LLC dba Snowy Mountain Software ("we," "us," or "our"), a Montana limited liability company. If you do not agree to these Terms, do not use the Service.

Description of Service

Snowy Studio is a cloud-based dance studio management platform providing tools for scheduling, registration, attendance, tuition billing, parent communication, and reporting. The Service is provided on a software-as-a-service (SaaS) subscription basis.

Accounts and Registration

To use the Service you must create an account with accurate, complete information. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account, and you must notify us immediately of any unauthorized access.

Subscription and Billing

  • Plans: A paid plan (Core or Pro) is required to activate and use your studio; there is no free trial. Subscriptions are billed monthly or annually in advance; annual billing is offered at the equivalent of ten months.
  • 30-Day Money-Back Guarantee: If you are not satisfied, cancel within 30 days of your first payment and we will refund that payment in full. The guarantee applies to your initial subscription payment and not to subsequent renewals.
  • Tuition Payments (Stripe Connect): Tuition you collect from families is processed through your own Stripe account via Stripe Connect. We do not take any application fee or cut of your tuition. You are responsible for Stripe's standard processing fees and for your own tax and refund obligations to families.
  • Payment Processing: All payments are processed securely through Stripe. By subscribing you also agree to Stripe's terms of service.
  • Cancellation: You may cancel at any time; cancellation takes effect at the end of the current billing period. No refunds are provided for partial periods.
  • Price Changes: We may change subscription prices with 30 days' written notice, effective at your next billing period.

Your Data

You retain ownership of all data you enter into the Service ("Your Data"). We do not claim intellectual property rights over Your Data.

  • License to Us: You grant us a limited license to use, process, and store Your Data solely to provide and improve the Service.
  • Data Export: You may export Your Data at any time through the platform's export tools.
  • After Cancellation: Your Data remains available in read-only mode for 30 days, after which it is permanently deleted.
  • Backups: We perform routine backups for disaster recovery; backup copies are deleted within 90 days of termination.

Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of applicable law
  • Attempt to gain unauthorized access to the Service, other accounts, or our systems
  • Interfere with or disrupt the integrity or performance of the Service
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Resell, sublicense, or redistribute the Service without our written consent
  • Use the Service to store or transmit malicious code, or to send messages in violation of anti-spam or telecom rules

Intellectual Property

The Service, including its source code, software, designs, text, graphics, and documentation, is owned by ZYEYZ LLC and protected by intellectual property laws. Your subscription grants a limited, non-exclusive, non-transferable right to use the Service. You acquire no ownership rights in the Service or its source code.

Service Availability

We strive for high availability but do not guarantee uninterrupted access. We may temporarily suspend the Service for maintenance or circumstances beyond our control, and will give reasonable notice of planned maintenance when possible.

Limitation of Liability

To the maximum extent permitted by law, ZYEYZ LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free, secure, or available at all times.

Indemnification

You agree to indemnify, defend, and hold harmless ZYEYZ LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

Governing Law

These Terms are governed by the laws of the State of Montana, without regard to its conflict of law provisions. Disputes shall be resolved in the state or federal courts located in Montana.

Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or a platform notice at least 30 days before they take effect. Continued use after the effective date constitutes acceptance.
